Lease Agreement

 

This lease dated February 9, 2010 between

Leasee(s)

 

  1. The TERM of this lease shall be the week consisting of Friday July 23, 2010 arrival at 4 pm and departure, Friday,  July 30, 2010 at 12 noon.
  2. The property will be ready for occupancy at 4pm on the beginning date of the lease and must be vacated by 12 noon on the end date of the lease.
  3. The PREMISES  is located at ____ Road, Bridgehampton, Long Island, New York  
  4. The Rent is $4200 and is payable as follows:  $2100 (1/2 the rental fee) and a $600 security deposit.
  5. The $600 security deposit is required and will be returned by the landlords within four weeks after lease expiration less any amount deducted for damage and or international/900/collect calls
  6. The  $2100 (balance payment for the rental) is due by June 23, 2010, one month (1) before the date of the leasee arrival.
  7. UTILITIES:  The landlord will provide water, basic cable, internet access, heat, electric, twice a week trash removal, local, regional and long distance (within the United States). Leasee(s) is responsible for any 900, collect, international calls made during tenancy, Pay per view, movies on demand 
  8. RESTRICTIONS:  No pets. No smoking on premises. No groups.
  9. ACCOMMODATIONS:  Two queen beds, Two twin beds with trundles, one crib. Sleep queen sofa and sleep twin chair in living room.  Leassors supplies linens for beds, beach and bath. Leassors will supply blankets, pillows and comforters for beds.
  10. MAXIMUM NUMBER OF OCCUPANTS:  The house is to be occupied by no more than (10) persons, including children, at a maximum.  VIOLATION OF THIS PROVISION SUBJECTS LEASEE TO SIGNIFICANT PENALTIES WHICH ARE NECESSARY TO PROTECT THE LEASSOR, AS THIS LEASE IS A SHORT TERM VACATION RENTAL.  SPECIFICALLY, HOUSING REGULATIONS LIMIT OCCUPANCY DUE TO THE CAPACITY OF THE SEPTIC SYSTEM OF THE PREMISES.
  11. LEASEE assures the LEASSORS that any tenant who violates any of the terms of this lease shall be immediately denied occupancy and shall remedy any damages or other expenses which are caused by the tenant and/or the tenant’s guest(s).
  12. LEASEE assures the LEASSORS that the tenants will observe all conditions and terms of this lease as to maintaining the premises in good order and appearance and will conduct themselves in a manner inoffensive to the neighbors.
  13. LEASEE agrees that any tenant who is found using drugs or allows others to use drugs on the premises will be immediately denied continued occupancy at these premises.
  14. LEASEE and/or their guests shall not disturb, annoy, endanger or inconvenience neighbors, nor use the premises for any immoral or unlawful purposes, nor violate any law or ordinance, nor commit waste or nuisance on or about the premises.
  15.   LEASEE agrees that during the term of this lease and such further time as he/she occupies the premises, he/she will keep the leased premises clean and free of trash, garbage, and other waste, and all the pipes, wires, glass, plumbing and other equipment and fixtures in the same condition as at the beginning of, or put in during the term of the lease; reasonable wear and tear and unavoidable fire being the only exceptions.
  16. LEASEE agrees to indemnify and hold LEASSOR harmless from all liability, loss or damage arising from any nuisance or harm made or suffered on the leased premises by the LEASEE, tenants, or guests from any carelessness, neglect, or improper conduct of any persons entering, occupying or visiting the leased premises.  It is strongly recommended that LEASEE obtain renters insurance.
  17. LEASEE agrees that he/she shall not paint or make alterations to the property, including changing locks or adding new ones, without the LEASSOR’S written consent.
  18.   Upon not less than 24 hours notice, LEASEE shall make available to LEASSOR or his agent, the premises for entering to make necessary or convenient repairs and to show the premises to prospective tenants.  In an emergency, LEASSOR or his agent may enter the premises at any time without securing prior permission from the LEASEE.
  19. LEASEE may not let, sublet or assign this lease for all or any part of the premises without prior consent of the LEASSOR.
  20. If LEASEE abandons or vacates the premises, LEASSOR may at this option terminate this lease, enter the premises, and remove all property.
  21. In the event that any action shall be commenced by either party arising out of, or concerning this lease or any right or obligation derived there from, the prevailing party shall be entitled to receive attorney’s fees as fixed by the court in addition to all relief at law or equity.
  22. Either party may terminate this lease in the event of a violation of early provision of this lease by the other party in the manner provided by law.
  23.   Upon signing this lease, LEASEE assumes full responsibility for fulfilling the terms of the lease for the period stated and assures the LEASSOR full recourse for the payment of any amount outstanding from the total amount due in accord with the terms stated above including any outstanding or unpaid charges that are the responsibility of the LEASEE.
  24.   In the event of cancellation of this contract by the LEASEE, the LEASEE will forfeit the rental fees and security deposit of $600,  unless a tenant can be found to occupy the vacated time reserved under this contract.
  25.   PENALTY FOR VIOLATING MAXIMUM OCCUPANCY PROVISION. VIOLATION OF THE MAXIMUM OCCUPANCY PROVISION CAN RESULT IN SERIOUS HEALTH PROBLEMS DIRECTLY RELATED TO OVERUSE OF THE SEPTIC SYSTEM AND MAY CAUSE LEASSOR DAMAGE DUE TO DETERIORATION OF THE SEPTIC SYSTEM WHICH IS DIFFICULT TO QUANTIFY. THEREFORE, IN THE EVENT LEASEE ALLOWS THE PREMISES TO BE OCCUPIED BY MORE THAN TEN (10) PERSONS, LEASEE SHALL BE RESPONSIBLE TO PAY LEASSOR THE SUM OF ONE HUNDRED DOLLARS ($100) PER PERSON IN EXCESS OF TEN PERSONS PER DAY FOR EACH DAY LEASEE ALLOWS THE PREMISES TO BE OCCUPIED BY MORE THAN TEN PERSONS.
  26. CANCELLATIONS OR EARLY DEPARTURE DOES NOT WARRANT REFUND OF RENT AND/OR DEPOSIT.

 New Clients, please sign and return lease with photocopy of drivers license/passport or other state issued identification card for each leasee. Also, if you have not already done so, please provide a residence address (not a p.o. box).
